Edgeworth Experts File U.S. Supreme Court Amicus Brief In Comcast v. Behrend

On behalf of neither party, Edgeworth CEO Dr. John H. Johnson, with Former Partners Dr. Greg K. Leonard and Dr. Laila Haider filed an amicus brief in Comcast Corporation, et al., v. Caroline Behrend, et al., demonstrating that scientifically rigorous economic methods can reliably determine whether damages to putative class members can be measured on a class-wide basis.

The central issue in Comcast v. Behrend is “whether a district court may certify a class action without resolving whether the plaintiff class has introduced admissible evidence, including expert testimony, to show that the case is susceptible to awarding damages on a class-wide basis.”

In their brief, the authors conclude that rigorous tools of empirical economics such as regression analysis, which are admissible as evidence under Daubert, can and do work in accordance with fundamental scientific principles to allow courts at the initial stages of litigation to address important issues raised with respect to the viability of class-wide damages.
